i. Reservations: Reservations are made on a first-come, first-served basis and can be made up to 90 days in advance during the summer season. Minors (under 18) are not eligible to reserve beach kits.

ii. Payments: Full payment is required upon reservation. Charges will appear from mybeachhero.com. Chargebacks for insufficient funds will incur a processing fee.

iii. Changes to Reservation: Changes to the reservation, including changes to the date, must be requested via email (to: pleasehelp@mybeachhero.com) by the reservee. All changes are subject to approval and subject to a change fee (as described in the Additional Fees section). No changes or additions to the reservation times can be made within two days of the reservation date.

iv. Cancellations: Reservation cancellations must be submitted in writing via email (to pleasehelp@mybeachhero.com) and incur a fee as outlined in the Additional Fees section.

v. Similar Specifications: Expect to receive a beach kit that closely follows the specifications of the provided example model. Please note that, although the overall quality will remain consistent, variations in color and brand names may occur.

Purpose

Outline procedures for canceling reservation due to bad weather.

i. Weather Monitoring: My Beach Hero will track forecasts before reservation dates.

ii. Cancellation Criteria: Reservations may be canceled due to heavy rain, thunderstorms, lightning, or severe weather warnings.

iii. Notification Process: Cancellations will be communicated via email, text, and our website.

iv. Refund Policy: Full refunds will be issued for canceled reservations due to heavy rain, thunderstorms, lightning, or severe weather; partial refunds for reservations that are partially completed.

v. Rescheduling: We will attempt to reschedule canceled reservations and inform reservees of the new details.

vi. Participant Responsibility: Check emails and our website for updates. Prioritize your safety if you feel unsafe due to the weather.

Safety First: Your safety is our priority.

i. Activities for Minors: Groups comprised predominantly of participants under 21 years of age must be chaperoned at a ratio of one adult (over 18 years of age) to 12 minors.

ii. Alcohol: Alcohol consumption is not permitted on beaches.

iii. Concessions: A permit is required to use County property for commercial purposes (Santa Cruz County Code Section 10.80.010). The County reserves the sole right to control all concessions in and about department buildings, park facilities, and beaches through separate agreements. Please inquire about concession agreements if you plan to sell items or food in the Parks and Beaches.

iv. Decorating: Light adhesive, removable tape (i.e., poster tape or painter's tape), zip ties, twine, and florist wire are the only fasteners permitted. Staples, tacks, nails, screws, stakes longer than 6 inches, and 3M Command products or similar products are prohibited. The release of balloons or animals is strictly prohibited—biodegradable confetti only; no rice throwing.

v. Drones: Drones or unmanned aerial vehicles are prohibited from use at parks and beaches.

vi. Flammable Materials: Candles, fuels, and hazardous materials are prohibited. Portable barbecues and cook stoves are not permitted.

vii. Lost or Stolen Items: My Beach Hero is not responsible for items left, lost, or stolen.

viii. Right to Refuse Service: My Beach Hero or designated representative is authorized to refuse or revoke any use agreement.

ix. Set-up and Clean-up: My Beach Hero will set up and clean up items included in the beach kit. The reservee must restore the My Beach Hero beach kit to pre-use condition. All trash and recyclable materials should be placed in the provided receptacles or beach receptacles. Please remove all decorations and personal belongings by the end of the reservation time. Clean up spilled food. Return all My Beach Hero items to their designated locations.

x. Smoking and Vaping: Smoking and vaping are prohibited in Santa Cruz County Parks and Beaches.

xi. Sublease: Reservee shall not assign or sub-lease any portion of the beach kit, or any rights under approved reservation, without prior written approval of My Beach Hero.

xii. Additional Provisions: County Parks and My Beach Hero may establish additional policies consistent with the provisions of the adopted rules and regulations as deemed necessary for the safe, efficient, and optimal use of the beach kits. Please check with the My Beach Hero for prior approval regarding uncommon or unique requests.

i. Change Fee: $50 if made within one month of the reserved date(s).

ii. Cancellation Fee: Cancelled reservations up to two weeks prior to the reservation are subject to a fee of 50% of the reservation charge. Cancellations of less than two weeks receive no refund of fees.

iii. Damage: Any damage to the beach kit incurred during the reservation period, as well as any additional clean-up required by My Beach Hero staff, will result in applicable charges billed to the Reservee. Please note that the cost for replacement or repairs to the beach kit will be based on the current hourly rate of My Beach Hero maintenance staff.

iv. Time Limit: Reservees are expected to adhere to the reservation times specified in their appointment. If the time limit is exceeded due to a late exit, the Reservee will be charged for the additional time at the daily reservation fee. This charge will be billed via invoice.

i. Assumption of Liability: The Reservee, whether an individual, group, or entity, is solely responsible for any and all liabilities related to persons or property that arise from the use of the My Beach Hero beach kit, including any damage to My Beach Hero property. The Reservee agrees to indemnify, defend, and hold harmless My Beach Hero and the County of Santa Cruz, along with its elected and appointed boards, commissions, officers, agents, and employees, from any claims, lawsuits, losses, or damages for injuries to persons or property that occur as a result of, or in connection with, the use of the My Beach Hero beach kit.

ii. Agreement to Abide by Terms and Conditions: The Reservee, whether an individual, group, or entity, confirms that they have read these Terms and Conditions. The Reservee agrees to inform all individuals using the My Beach Hero beach kit about these Terms and Conditions and ensures that no violations shall occur during the use of the My Beach Hero beach kit(s). The Reservee understands that permission to use the My Beach Hero beach kit is contingent upon adherence to these Terms and Conditions. Furthermore, this permission may be revoked at any time if the users of the My Beach Hero beach kit(s) fail to fully comply with these Terms and Conditions.

iii. Reservee, or Representative, to be Present: Reservee, or the group or entity individual named in the Reservation, will be present during the entire period of use of the My Beach Hero beach kit.

i. Amplified Sound: A sound permit is required for any event using these devices: public address systems, electronic equipment, live music, and amplification.
